Accepted as true

As of today, May 24, 2009,
No rebuttal exists of any kind.
The sworn affidavit now stands as law
All officers are quiet, I am appalled
The Bank of Ozarks did refuse payment
That infamous day of betrayal treatment
A construction loan of $61,000.00
Was dismissed by law; then they soon hollered

ON February 27, 2008,
A checking account was opened that day.
I deposited a check from the sale of my home
A certified check which would pay off the loan.

I have the evidence neatly tied up
A copy of the bank check all locked up.
The deposit slip, the Disclosure, Notice of Hold.
The Signature Card and account number told.
Affidavit of Fact showing refusal
Of payment by the Bank, those dipsy dusals!.

We spoke to the banker to pay off the loan
Eleven days later he would call on the phone.
ELEVEN DAYS?! Said I in disgust.
That certified check is more than enough.
Verify the thing, You know what to do
That check has been paid for it is true blue.

But little miss Dana, the little V.P.,
Decided the cards would fall differently
You don't like our terms. No you don't, not at all
So we are closing your account, you are not to call.
Your account is shutdown, we will not accept payment
No, no, you do not like our delayment.

We went to the bank to speak with dear Shawn.
The loan officer compadre that aided the wrong.
Our contractor was with us; He listened quite well
He signed the sworn statement right away; pell mell.


George Gleason was called in March twice by phone
No answer was given he wasn't at home.
George Gleason was served with Notice of Intent
In March and in April we thought he would vent
But NO RESPONSE was forthcoming; Not even a peep.
Dear Mr. Gleason was most likely asleep.

All banks operate through UCC rules,
No If, And's, or But's about these rules
3-603 is Tender of Payment
Good old Ozarks owe Bill one big payment!
